  1. The judge probably didn’t have a capital murder case that was in the national news and bent over backwards to be fair and punted the case to the neighboring county for trial. The Idaho Supreme Court will give the trial judge a deference in his decision since the defendant will still have a fair trial, except it will cost more money for the government.
