The 4th Amendment protects individuals from unlawful searches and seizures. The police can’t search you, your house, or your vehicle without a warrant or probable cause that a felony crime is being committed. The office had a right to question the driver because his vehicle matched the vehicle with the stolen plates. When he opened the vehicle door and tried to get the driver out of vehicle and fired at the driver, he violated the 4th Amendment and assaulted the driver.

@Shadow Responder Pennsylvania vs. Mimms doesn’t apply, this wasn’t a traffic stop on public roads, and he was parked legally at a private business parking lot. The officer did not ask the driver to step out of his vehicle, but opened the car door. The 4th Amendment applies to seizure or detaining a person as in “Stop and Frisk“.

@Shadow Responder A traffic stop is because of a traffic violation; he was parked. “Under the Fourth Amendment of the U.S. Constitution, a police officer may stop a suspect on the street and frisk him or her without probable cause to arrest, if the police officer has a reasonable suspicion that the person has committed, is committing, or is about to commit a crime and has a reasonable belief that the person "may be armed and presently dangerous…" Terry vs Ohio. The cop had no reasonable suspicion to remove him from the car.

@Shadow Responder There was no parking or moving violation parking at McDonald just eating. He was already "stopped", the cop opened his door and pointed a weapon at him without any reasonable suspicion of him being armed and presently dangerous per Terry vs Ohio.

@Shadow Responder The cop thought he was the suspect that ran from him previously with stolen plates. Since the guy wasn’t charged with having stolen plates, the cop didn’t wait to confirm that the plates were stolen on the vehicle and had no reasonable suspicion to open his door.
