The US Government didn't bar New Yorkers from using the fast track because they allow Illegal immigrants to get a driver's licence. The US govermnment barred them from using the service because part of the law says the US govermnent cannot use the driver's license state database to determine if someone commited a crime that would PRECLUDE them from using the fast track service. New York told they feds they can have no access to check a driver's criminal history so the feds said well, then since we can't be assurred anyone isn't a convicted drunk driver, etc, we're not safe in letting New Yorkers use the fast track flying PRIVILEGE. It isn't a right to use that service, it's a privilege.

@itsbayside6802 Yeah right, California doesn't need any federal funding. Let's just see about that when the feds remove the billions they give California.

@jdanon203 And the feds have the ability to withhold funding to those municipalities that do not enforce federal law and in many instances hinder federal law enforcement. So a state can decide if it wants federal funding or not. Many states did not have a 21 year old drinking law. In many states the law was 18. The feds said fine, if you wish the drinking age to be 18, the feds will not subsidize your highways. They did the same thing when states didn't want to adopt a 55 mile per hour speed limit to conserve fuel. So yes, states can decide to do such things and the feds can respond by withholding federal funding. The courts work it out.
