I've got an odd feeling that he didn't do it even though I believe I should think he did. I normally always think the person is guilty in these scenarios. This one has me perplexed. i'll be paying attention to the evidence and will formulate my opinion as we go ;).

He passed by the area where the phone was located at 42 MPH. He didn't stop there. He could not have thrown the phone that distance from his vehicle. That is a lot farther than he could have thrown that phone while driving 42 miles per hour.

Are you kidding? We watched Alex Murdoch's and his son's face when the verdict was read in a murder trial. Who cares if we see her face when the verdict is read in a civil trial? There's no privacy law in play here.

More importantly than that, in this instance the prosecutor tried to go down a path that the court had previously said it wasn't going to allow, namely the fact that the Defendant had commented in that past that he wished he could use deadly force to protect property. That is irrelevant in this instance as there has been no evidence introduced that occurred in this instance. It was purely prejudicial and the prosecutor tried to get it past the defense..

He was clearly in the middle of a paranoid psychotic break and was complying until the officer shot him with less than lethal, first. This will be ruled a righteous shoot but it was clearly an unnecessary shoot.

There was no need for that to escalate to deadly force. He was unarmed. Why was she confronting him alone? Where was her taser? This was a class in bad decisions.

For CNN's counsel to allege that they can serve an SDT for records and NOT notify the other side because they thought it was merely a "witness subpoena", is not only not believable, it's bad lawyering. You'd think CNN could afford lawyers who know the law regarding subpoena duces tecum for records.
