It might be a cultural difference, but I think this law is bit harsh. However, that's not to say that I think it's right for a married couple to do something like this to their spouse. I think the intention is good but maybe the practice not so much. Plus, there's also the chance where 1 side of the couple could claim that their spouse cheated on them even if they didn't...all with the intention to try and cheat the system and get money.
