  3. “… allowing jurors to pick one of three …” That’s not what happened. He was only indicted on one — altering business records in the first degree. That was not the jurors’ choice. But it requires that there be an underlying crime which the criminal was concealing by altering the business records, and several possible underlying crimes were presented and the jury did get to choose which ones they thought trump was trying to hide. That— choosing an underlying crime— is very different from choosing among charges. The charge of altering records to conceal a crime doesn’t change depending on which crime is concealed.
