The trouble is if Dems expand the court by a small number of seats – I think the number 13 has been floating around so that would be a four-member expansion— Then Republicans when they acquire power (which they will sooner or later) will just expand the cord a little more – perhaps 19 seats. The solution is: immediately after the election well immediately after inauguration, the Democrats should expand the court by a large enough Number of seats that further expansion would be Absurd. In other words, Democrats need to think big – bigger than they usually think. I propose that when Kamala Harris becomes president, Democrats should expand the court to 47 seats – which would mean appointing 38 new progressive minded justices. That way if Republicans try to recapture the court by expanding it, they will likely have to make it bigger than the US Senate itself. I don’t think they’ll be ready to do that. Laugh if you like, but I’m quite serious. We have a radical problem with the Supreme Court, And radically innovative, thinking will be needed in order to fix it.
