I disagree that AI training infringes on copyright. That said, training it on pay-to-access copyrighted material that they haven't paid for is just plain piracy. Just as a human can read (or otherwise partake of) copyrighted material and learn how to create original material from what they learned so too should AI be allowed to be trained on publicly accessible (or pay for pay-to-access and then train on) copyrighted material. If a user then subsequently uses the AI to reproduce said copyrighted material and uses it in a manner that is not in accordance with fair use then that user should suffer the normal penalties. AI is a tool, no different than any other. The person who uses the tool is responsible for how they use it. If someone reproduces copyrighted material with Photoshop or Microsoft Word and sells it then that person has broken copyright law, not Adobe or Microsoft. This is obviously my opinion, not legal advice. I am not a lawyer.
