  1. The prosecutor on the Casey case screwed up - they only charged first degree murder. So when the jury could not agree that Casey premeditated the death of her daughter, they had to find her not guilty of the only charge brought against her. The prosecutor should have also charged her with lesser degrees and then allowed the jury to decide which fit. But now, due to the double jeopardy law, they can't prosecute Casey again.
