  1.  @jaqenhghar1631  The president is the one who decides which are presidential records and which are personal records. See "Judicial Watch v Bill Clinton-Taylor Branch" regarding classified audio tapes that were in Clinton's personal possession: "The Court has serious doubts about whether the former President’s retention of the audiotapes as personal is a matter that is subject to judicial review. But the Court need not decide this question because whether judicial review is available or not, the relief that plaintiff seeks – that the Archivist assume 'custody and control' of the audiotapes – is not available under the PRA," Jackson wrote in her decision. It would seem that, based on this ruling, that NARA and the FBI overstepped their authority in seizing records from Donald Trump's home.
