If you want to be technical, he was already acquitted of Jan 6 involvement in the Senate impeachment trial. Even the FBI publicly asserted there was no insurrection.

Using the military to take out political opponents would not be within the realm of the president's official duties, and thus immunity wouldn't apply. Without immunity, BO would be vulnerable to charges from his drone strike on American citizens.
