  2. If Kyle were a police officer, would the same actions be considered justified? If you answer yes, then Kyle is innocent, since police have no more right to self defense than the general public.

  3. It's still a free country, Kyle has a Constitutional right to freedom of movement . He can be anywhere he is lawfully permitted to be. Last time I checked, he could legally be where he was, so anyone stating "he shouldn't have been there" is one's opinion, not a legal argument.
