Batman operates outside the Law and doesn't possess superpowers. If he was a vigilante who often killed criminals, he would not have a working relationship with Gotham PD, who were against, then for, and now against again. The Joker was his nemesis and between,them it was personal. Bruce struggled and certainly came close to killing him several times. In The Killing Joke, he was ready to kill the Joker. Gordon said no. In Death In The Family, he was interrupted by Superman. Batman could not afford to just kill criminals whenever and be tolerated by law enforcement agencies and the likes of Super men. But, yes, the Joker deserved to die, and Batman felt torment over not killing him. But remember the Joker lay dormant for years, in this particular alternate future. Frank Miller, for all his faults crafted the perfect story, only surpassed by The Killing Joke.

T FP Actually, great metaphor.,Batman trains hard, renounces his humanity to become a superior being, but the Joker operates off the crazed one-time only madman strength of strong emotion. The Joker doesn't train. He is never weary. Batman enters the fight tired, which gives them a more equal status.

The Joker in comics had a bisexual vibe and certainly loved Batman in that he gave the Joker purpose. Random victims and acts of terrorism weren't enough. Batman choosing to sublimate his anti-social anger and broken psyche into a GOOD cause was something for the Joker to destroy, thus proving his theory that one bad day van turn you evil/ insane and that life has no meaning. The Joker loved and hated Batman. It was a similar relationship to Lucifer and Jesus. The Devil trying to convince that God must be disobeyed, for He is not Good. And the hero, Jesus, Batman, etc, suffering incredibly by not giving into temptation.
