The constitutionality of the hearings depends on what Congress tries to do afterwards. Right now they are simply making noise and wasting time, and having the people who refuse their subpoenas prosecuted. These are all within their power. However, in order to take action against anyone who was never asked to appear, they have to refer the matter to the executive branch. They cannot simply declare that Trump has done things which preclude him from seeking election, because that would constitute a bill of attainder. It requires a lawful sentence consequent of conviction by the judicial branch.
