The main reason we're in this situation is because the IRS was chronically butt-hurt over the failure of tipped employees to report their tips. They tried to get the employers to do this, but the employers had no incentive, until the IRS hit on the idea of allowing tips to be included as part of the minimum wage calculations. Now the employer has an incentive to track every red cent of tips and report them to the IRS so that the don't have to pay as much out of their own pockets. Up until now, tips (under law) were considered to be a gift from the customer to the employee, and the employer was not allowed to take them. Now, under the new policy, the first $5.12 of tips has essentially been taken by the IRS and given to the employer. This is why there is now a line for tips when you pay with your charge card, and why the percentage has gone up from the traditional ten percent to starting at fifteen percent with options for higher percentages. It enables employers to push their payroll onto the customer.

As a software developer I can't see YouTube having any trouble enforcing their ad policies. The length of each ad is known. When the user requests a video, the ad is sent to the client machine, and then transmission of the the video waits until the time taken to watch the ad has passed. The end user either watches the ad or waits doing nothing for an equal span of time.

A contract that allows the other part to stop providing the service at their own discretion is not a contract.
