You're making much to do about nothing as is this prosecutor.
Why is it unlawful for the President of the United States, to require that the States, prior to certifying an election, investigate and insure that all allegations of impropriety in the election, are not as they appear.
A lot of improper actions were taken during the 2020 election.
In Detroit, republican observers were forced to stand outside the poling room while their democrat rivals were permitted to be inside the room. That placed them to far from the ballots to actually do their job.
Then, according to the observers, paper was placed over the windows so that they could not see the ballots. When they complained about this, the were forced to leave the polls by police.
Allegations like these should always be properly investigated by the State legislature prior to certifying an election. Without such investigations, to insure that the election was conducted lawfully and fairly, democracy does not work.
Then there's the claim that election data was sent over seas to Germany and processed prior to being accepted as valid. Why? Are Americans, who have been conducting fair and legal elections for well over 200 years, suddenly too stupid to count and validate votes?
Democrats alleged that the 2016 vote was stolen, no one deemed that an attempt to change the election.
It is not the obligation of the defense to prove innocence.
It is the obligation of the prosecution to prove guilt.
What that means is; no matter what kind of a motion the prosecution files with a judge, the defense attorney is going to file a counter motion.
Filing said counter motion does not constitute as some people wish to allege, wasting the judges time. The judges job and time is allocated for hearing both prosecution and defense. You are not guilty of something, simply because someone accused your actions of being guilty of a crime.
In regards to the prosecution's allegation that trump was threatening someone; the prosecution must prove that the words Trump spoke were in fact threatening.
People take offense too, and call threatening, anything that they disagree with. At least one women I'm aware of, of her own initiative and prompting, convinced a man to have sex with her and when he did not respond to a text message she sent him the next day, accused him of rape. What she was not aware of is that prior to agreeing to have sex with her, he recorded her on video asking him for sex.
The innocent until proven guilty clause in the Constitution is found in Article III Section 3 of the US Constitution under the heading of Treason. Not only does the government have to prove guilt, the government is not allowed to pass the guilt of a convict, onto their children or associates.
