  1. The Law would allow a Plaintiff to sue if the ILLEGAL USE of a Firearm caused harm, even though the firearm was legally manufactured. That directly violates the Protection of Lawful Commerce in Arms Act… It’s just Newsom’s response to Texas allowing Individuals to sue Physicians that perform illegal Abortions, and it will fail miserably under challenge in Court. It’s also Unconstitutional. Ex-post facto laws are expressly forbidden by the United States Constitution in Article 1, Section 9, Clause 3 (with respect to federal laws) and Article 1, Section 10 (with respect to state laws). You can’t make something Illegal after it’s already been deemed Legal.
