At around 6:00m the phrase "default on this capital" has no meaning. You can default on a loan because you have an obligation to pay it back. Failing to pay is a fault, or default, on the implicit promise. There is no promise to repay involved in soliciting a capital investment. If somebody invests in your company and the company goes bust, their money is gone where the bindweed twines -- and you screwed the pooch, to use another technical term of similar provenance, accountancy. But you didn't default. You just fucked up.
