Check your historical facts. A German new boat may have sunk an American destroyer prior to December 7, 1941, but the US did not use that to declare war in Germany. Yes, you both were sinking American ships, cargo ships, prior to the attack of Pearl Harbor , but the US also did not use that as a pretax for declaring war on Germany because Germany had warned everyone that sending ships to Britain was sending them into a war zone and if the US wanted to send their ships into a war zone, they would be sunk. The act that caused America to declare war on Germany was the fact that Hitler declared war on the United States after the Pearl Harbor attack, even though his treaty of mutual support with Japan, did not require Germany to declare war on a country that the Japanese attacked, only on countries that attacked Japan.(Note, I am paraphrasing Sarah Paine here.)
