In general there aren't good answers to your questions yet. If at some point we can develop brain scanning technology for both the accused and the accuser that would be a start, but we are years or decades away from that - if ever. But retraumatizing someone who is a legitimate victim of something as horrendous as a sexual assault, be that a woman, man or child, should obviously be avoided. These kinds of cases need to be tried in a different process and setting than standard legal proceedings. Perhaps it would help if the examination is done outside of the courtrooms typical adversarial structure with everyone on display and under a more clinical setting where only the judge, witness(es), attorneys and mental health professionals would be involved in the testimony and cross examination. I'm not even sure if the accused should be in the same room as the witness unless they are shielded from line-of-sight contact as this could intimidate someone who is a legitimate victim. I understand the principle of being able to confront your accusers, but maybe sexual assault cases need to be an exception to that principle. At the same time, anyone who uses sex as a tool to advance their career should be ashamed of themselves and be ostracized from that profession as they are as much a part of the problem as the person rewarding them for doing so. It's damned unfortunate how many of us are broken to one degree or another and how hungry some of us are to be famous.

Biliary Clinton Hurting the innocent and falsely accusing someone are my greatest fear when it comes to the criminal justice system. While we express the concept of one being innocent until proven guilty, the reality in many cases, especially in communities of color, is the opposite. And police and prosecutors lying people to get them to take a guilty plea to avoid a worse sentence is a way too common reality. The whole damn system is a mess and I don't have all the answers. They are out there, but they would go against much of the ideals we believe in. Thanks for the conversation, but I'm done with his thread. Especially after John Doe's comment.

Biliary Clinton My point was that sexual assault is a uniquely traumatizing experience as there a shaming implicite the act and afterwards, but I understand your argument that any especially violent assault is going to be similarly traumatizing. Although I do believe there is a difference between being robbed, even at gunpoint, or having your car stolen without being taken hostage and the more personal attack like a rape or home invasion/carjacking. Maybe violent assault crimes in general need to be tried in a different way more along the lines you or I described than civil and other nonviolent cases. I've often thought that we shouldn't be housing violent and nonviolent prisoners together. Maybe that should be expanded to the trial process as well.

@Dustyone23 Agreed with some exceptions. Although I'd make a distinction between sexual deviance and sexual assault - especially when the sexual assault is one of many.
