@TK-en2hq initially it wasn't as only the northern states acted on it before reconstruction took place. The southern states ratified it as part of re-admission. Kind of forced on them, but they did approve it and can apply it if needed to any rabble-rousing northerners who try to incite insurrection.

@kurt1391 I think it might be in Trump's favor (not sure about 9-0), but it'll be a hollow victory for Trump because the 'Supremes' will want the determination of insurrection (and its definition) to be done in lower trial court in front of a jury of the people (the D.C. case Trump is facing in March). Get that ruling and its possible Trump could be tossed off ballots "en masse" and the DC Appeals court and Supreme Court will reject any Trump appeals from the DC Trial Court guilty outcome.

Peter, you made one mistake. The Republican Convention isn't in March, its in July. You're thinking of 'Super Tuesday' a day when quite a few states have their primaries, and whoever come out of that day with the most delegates will probably be the odds-on favorite for the Republican party presidential nomination. Good take on what John Roberts and the Supreme Court should be doing, trying to get the law making responsibility back over to the legislators on Capitol Hill and not dumping problems in their lap except in odd cases.
