  2. To be clear, the perp that got shot in the taco place didn't shoot the cell store father, one of the others in the robbery crew did. . The perp was part of the robbery and therefor initially charged with capitol murder, meaning , if anyone dies during the commission of a violent crime, ( even one of the perps, ) everyone involved in the robbery is charged with the death.
