Videos like this should be required viewing for kids about to become adults. It use to be called civics. It should be taught under the header this is how you don't interact with the police.

If someone can't understand how this yahoo lost this court battle look up every court case that had to do with the eighth amendment. He really had no idea what he was talking about and could have said himself a butt load of problems if he had just listened.

David definitely took advantage of a weakness in the security industry. Now before i go into this security is a good investment just understand the quality of the guard is going to depend on his background and how many there. I worked security for 5 years and knew only a handful of guards with police or military backgrounds and almost all of them were retired. With that said, depending on the site you may have only 1 or 5 guards at any given time. Depending on the state they have very limited authority, in some sites none at all they are just there so the site can get a tax write off, so what does that translate as in David's case? Well without a criminal background security really couldn't do much at all. In fact I am willing to bet that David knew their patrol routes and when they did their patrols. I am also willing to bet the mortuary was forbidden for them to patrol. I have worked sites where we had the keys for specific areas but we were never allowed to go in for whatever the reason maybe. Mortuary i can see being one such area just because of what it is. This decision would be from the sites management. Long story short having worked security i can see ways someone like David can take advantage of security gaps especially if security's contract limits their authority. It sucks especially if you are a guard trying to do your job but it sucks even more for the victims.
