The problem is that a 'murder' charge could have split the jury and he may even have walked: this happened in the case of Louise Woodward and the rioters who attacked Reginald Denny. The pos tortured, beat and tormented that child, and clearly intended to keep doing that he was guilty of serious abuse but the prosecution would have had real trouble trying to get the jury to agree to murder 'beyond reasonable doubt'. He'll be in prison for the rest of his life and every morning he'll wake up hoping none of the inmates get their hands on him. He's a marked man - he may even be killed in there.
