@popscoulter7587 It has to establish a clear and present danger.

@Nith Attempting to operate a motor vehicle while either under the influence of drugs/alcohol establishes a clear and present danger to every other motorist, pedestrian on the road.

@MVargic Attempting to operate a motor vehicle while intoxicated establishes a clear and present danger to every other pedestrian, motorist on the road!

@popscoulter7587 I'm not underestimating that. Punishment comes from after the fact when a crime is committed not before the fact. The idea concept of 'pre-crime' sets up a very dangerous, reckless, stupid precedent not to mention blatantly unconstitutional.

@popscoulter7587 Whoa whoa I don't advocate for zero laws nor lawlessness. I'm not an anarchist! Your fireworks analogy falls under gross criminal negligence. Punishing those after the fact makes more sense than punishing those before the fact. Oversentencing, Overcriminalization from stigmatizing nonviolent, victimless crimes has lead to many of economically disadvantaged individuals esp. poor minorities got tossed into the prison-industrial complex!!!!!!!!!

@circuswerld It's crony coporatism where for-profit prisons are jointed at the hip the state to lobby for unjust laws and no-bid contracts!
1
@circuswerld BTW FYI I'm a pragmatic populist libertarian civic nationalist/constitutionalist/minarchist. I'm also an agnostic-atheist.
1
@circuswerld Prisons should be about not only punishment but rehabilitation. Privatization leads to corporatization and it's not the same as the free market.
1
@circuswerld For you as a so-called Christian conservative I thought you would believe in second chances.
1
G N I said only abolish privatized prisons not state-run, federal-run penitentiaries.
1
@circuswerld Cuz' of the prison industrial complex profiteering, racketeering off of first-time nonviolent drug offenders whom re-enter the system over and over again. Since they have a felony on their record they can't get jobs to support themselves to lead productive lives onward toward the o redemption.
1
G N You understand privatization leads to corporatization which it's not the same as a free market.
1
@circuswerld Do you realize what I'm trying to explain to you? Privatization/Corporatization is the not the same operating in the free market.
1
@circuswerld Some things like prisons, military, police can't be privatized/corporatized cuz' it will lead to more entrenched with maximizing profits, socializing losses cuz' of artificial gov't.-created monopolies/oligopolies.
1
@circuswerld I just did. Some things like essential services can't be managed in a free market. It's a balancing act between capitalism with some socialistic approaches like following a recipe to bake the perfect cake.
