Probably 99% of what the US Federal Government does is unconstitutional and therefore illegal. Trump, however, is right to challenge this so it can ultimately go to the Supreme Court if need be. Constitutionalists would look at the INTENT and the intent was NOT to allow millions to illegally cross the border and crap out babies.
