  5. No lights involved here. There are always things in front of you. The key factors are the distance to them and your speed. Regardless of whether some object has a right to be there or not, a driver has a duty to try to avoid a collision. When the object is more massive than your car, your life may depend on it.

  7. How do you know they were racing? Some reports just say the Tesla was overtaking the Ferrari, and the driver of the Ferrari sped up to prevent the Tesla from passing. That’s not exactly racing. In any case, the Ferrari caused the crash. The Tesla didn’t hit anything. The Tesla driver is a witness, though.
