You are wrong. Garland appointed Jack Smith as Special Counsel, and he is doing an excellent job. Meanwhile, Garkand is runninf the Dept. of Justice. That is not supposed to be a political position. The real reason we are in this position is that most Republicans in the Senate refused to convict Trump on his second impeachment charges. He should have been barred from federal office then.

It is a real concern. Just look at the Senate, controlled by Republicans, to see an example of abdication of responsibility. It used to be that the Senate was proud of its role as an independent part of the government with the power to act as a check on the President when necessary, even when they were of the same party. Now, they are lap dogs when the President is of the same party as the Senate majority. There are no great senators as we had in much of the history of the Senate.

In the post Civil War era, I’m sure the 14th Amendment was applied without conviction in a court of law. The Congress applied it to exclude certain members of the Confederacy from the Congress. I think the 2nd impeachment trial of Trump is relevant here. While the Senate fell short of the supermajority required to convict on the impeachment charges, they did have a majority declaring that he had incited insurrection. The 14th Amendment does not require a supermajority, or even any kind of trial to determine ineligibility. I think the majority vote in the Senate is sufficient evidence to cause Secretaries of State to exclude Trump from their ballots. They should cite the Senate vote when they do so.

It is my understanding that the US Dept. of Justice does not routinely release booking photos, so that may be part of the reason we have not seen photos from the federal cases. Is that correct? People are eager to see the Fulton County booking photo, but admit it: we know what he looks like.

Joe Biden is President-Elect. The term does not require any formal action to come into use. It is used by everyone who recognizes that Biden has achieved a solid victory in the election.
