A candidate for life, I hope.

The family courts decide such questions. She did not have legal custory of the boy.

Fifty years is essentially a life sentence. It doesn’t solve the real threat, which is that the truck owner who put him on the road in a heavy truck is still in business under a different company name. Incompetent drivers are directly responsible for wrecks, but there is a system which put them on the road which continues to be a threat.
16
I can understand that. A reduction was appropriate, but this was too soon and too much.
13
The House has the right to adopt such a rule, even though she has the right to carry the sidearm in the District. The Capitol just needs to provide a place to check firearms.
13
Even the judge and district attorney think the sentence is too long. It is an artifact of mandatory minimum sentencing law which requires consecutive sentences in some cases. Freeing him is not appropriate, though. It must be made clear that incompetent drivers should not be driving heavy trucks on our public roadways.

Most people have three names. They give them all to reduce confusion with others who may share the first and last name.
6
Intent to do what? If a person does not intend to kill, but does an intentional act negligently or recklessly which causes human death, that is criminal.
4
The prosecution did not ask for 110 years.
4
baloney
4
Such questions are a private matter. The way to challenge a decision of a court is to appeal to a higher court.
4
Both of Colorado’s senators are Democrats. Colorado has voted Democratic for President in about 1/3 of the elections.
3
As part of his plea deal, he agreed to testify in the trial of another defendant in the case. His own sentencing was deferred until that trial was finished.
3
@wahhbajack — The experiments had nothing to do with it. As an undergraduate, he participated in some psychology studies. Countless college students have done that. Kaczynsky himself said that it was not an extreme experience.
3
@Lorimars319 — You have not been following this at all, it seems. You cannot get out of a vehicular homicide charge simply by claiming your brakes failed. Competent truck drivers do not rely on their service brakes to come down a hill safely. Before reaching the downgrade they must slow to a safe speed for the grade, then use gearing and engine braking to control the speed. If the driver believed he had a brake problem, and there was evidence that he did, then he should not have attempted to descend the grade. For that matter, he should not have driven the truck further until it was repaired. If you drive a heavy truck or are planning to do so, you should learn something from this incident before you get in similar trouble.
3
This trucker knew little about law, which is why he is in such big trouble now.
2
His reckless operation of his truck caused this wreck, even though he did not intend it. Incompetence is not a defense.
2
It wasn’t really about the brakes. You can’t get out of a vehicular homicide merely by saying “the brakes failed.” If you are a driver, it would be a good idea to learn what your responsibilities are instead of just complaining.
2
He was not forced to take a plea deal. He was offered one. He declined it.
2
That would have required a trial for each, with no one testifying against another.
2
All that is happening so far is that a hearing has been scheduled to consider the possibility of changing the sentence. It may not result in any change at all, because the judge believes the sentence is mandated by law. The next step would be appeals to higher courts. After the legal process has run its course, the Governor of Colorado might make a reduction in the sentence. All this will take some time, so there is no point in beng impatient. I don’t know what you mean by “clemency.” That just means moderation of the severity of the punishment. If you are expecting that somehow he will get off, I think you should forget about it. He killed four people through his reckless operation of a vehicle, and that deserves a significant sentence.
2
If you are a driver, you had better learn your responsibilities as a driver or give up driving.
2
@lawrence1986ify — The news reader said “the victim is from Thailand.”

I won't malign them, but I don't want one as a pet. Why would anyone?
1
Different state. Different case. Different jury. No comparison.
1
“Accident’ doesn’t mean anything, legally. It just means unforseen consequences. It does not mean his actions were not criminal.
1
The wreck was entirely his fault, but 110 years is not appropriate.
1
That’s why it isn’t murder. It is vehicular homicide. Negligence.
1
He was negligent in several respects. It was his responsibility to operate his vehicle safely. If it could not be operated safely, he should not have driven it.
1
This case has no racial aspect. “Cuban” is not a race.
1
He is white. “Cuban” is not a color or a race.
1
It is a consequence of adding up terms which are to be served consecutively.
1
He is white.
1
As a professional driver, he is responsible for checking his brakes. If they are not working properly, he must park the truck until they are fixed. He is also responsiblr for using them properly, which means not abusing them.
1
He is a legal immigrant.
1
He is a legal immigrant.
1
I think his luck has run out.
1
President Biden has not invited any illegal aliens to the White House for Christmas. Remarks like that serve only to display the incredible ignorance of Republicans.
1
He was sentenced days ago. Everybody who is convicted of a crime is sentenced.
1
It isn’t that easy to compare criminal cases. Different facts. Different charges. Different states with different laws. Different juries. There is no general rule that can be drawn from these two cases because neither is typical.
1
Breaks do not get “lost.” If the truck had brakes, he could not have made it from texas to Colorado. The fact that he said he lost his brakes is incriminating, because it means he was expecting his brakes to control his speed on a downgrade. The only way the speed of a heavy truck with a load can be controlled on a downgrade is by getting into a low gear before starting down the hill. Most likely he destroyed what brakes he had on that hill.
1
“Accident” is not a helpful term. A homicide does not have to be intentional to be criminal. The question is: what was his negligence?
1
All that means is it isn’t murder. Anybody who drives needs to understand this. If you run over someone, just saying “I didn’t mean to hurt anyone” doesn’t get you off.
1
Professionals are trained to handle emergencies. Think of Captain Sullenberger, ditching an airliner in the Hudson River with no loss of life. We need better training and certification of truckers because this driver was clearly incapable of dealing with an emergency. His lack of training and poor crisis management skills do not get him a pass, however.
1
“Cuban” is not a race. He is “white.”
1
Probably it will be revoked, if it hasn’t been already.
1
The defendant was offered a plea deal which would have dropped most charges. He wanted a trial, so the DA filed every charge she could support. That’s the way the system works. The jury did acquit on 15 charges, so he could have fared worse.
1
It is. A criminally negligent accident.
1
He may not have had a Jake brake, and if he started the downgrade in too high a gear, he might have been unable to downshift.
1
“Accident” means only that he did not intend to kill anyone. But a homicide need not be intentional to be criminal. He was negligent.
1
The little old lady probably stepped on the wrong pedal. Most people who run into something say “my brakes failed.” Usually, it’s baloney.
1
To make it easier to get through the long comment section, skip all entries by people who cannot spell “brakes.”
1
He was not charged with murder.
1
Even people who can cook an excellent hamburger like In-n-Out once in awhile. Even Julia Child ate In-n-Out.
1
Brooks has not yet been tried. That incident just happened recently. He is being held on $5 million bond.
1
He is white.
1
No, he was not asleep.
1
@deeray0604 — He was steering his truck.
1
Professionals don’t blame their tools. Eaton makes transmissions for professionals and professionals know how to use them.
1
Legal adults, but not grown up.
1
He was sentenced under Colorado law, not US law.
1
@1611AuthorizedVersion — He passed four exits, not four escape ramps.
1
@ydro11 — That video doesn’t cover the entire route. I would like to see a Colorado DOT map showing the location of all emergency escape ramps, but I haven’t found one.
1
We don’t see a “fireball” in this video, just a fire. He was carrying a load of lumber.
1
He is white. “Cuban” is not a race. “Hispanic” is not a race.
1
Brakes were not the problem here.
1
He was not charged with murder.
1
The sentence is unreasonably high, but it is hard to decide what is reasonable without knowing how much he was negligent. These articles always say “his brakes failed” or “he lost his brakes.” More likely, he destroyed his brakes by improper operation of his truck. Heavy trucks use low gears to control speed on downgrades, not service brakes. What gear was he using to start down the grade? Was the grade marked? Could he read the grade sign? What training did he have? Was he properly licensed for heavy trucks? Can a driver be licensed without demonstrating knowing how to take a downgrade safely?
1
It ought to be about 15 years, in my opinion.
1
The sentencing system varies from state to state, except for federal crimes. This was a Colorado case.
1
You don’t understand the law. “Accidental” does not mean that a homicide is not criminal, it just means that it is not murder.
1
A governor can’t control rolling speed. He was freewheeling downhill.
1
You are missing everything.
1
The acquittal of a homicidal child vigilante, for one.
1
She misspoke. She meant to say they have too many patients.
1
The driver refused to negotiate a plea bargain. I’ll bet his attorney advised him to plead out, but a defendant cannot be forced to plead guilty.
1
The prosecutors started by offering a plea deal. He turned it down. Bad choice.
1
Any firearm regulation is a big deal to a gun nut.
1
Karol-Chik agreed to testify in the trial of co-defendant Koenig. His sentencing was deferred until the completion of the trial.
1
Three losers. Were almost done with high school! What should we do next? Oh, let’s just throw away everything adulthood promises by committing a dumb@$$ felony.
1
The brakes were not the cause of the wreck, despite all the talk about them. Truckers do not depend on brakes to get down a hill. Low gears, supplemented by a Jake brake, are used to descend a hill. Very little use of service brakes should be required. There was evidence that he knew his brakes had been overheating before he got to that grade, yet he went ahead, probably in too high a gear.
1
There are many videos. He was convicted on 27 counts out of 42 filed. Four of those convictions are for vehicular homicide.
1
The sentence comes from Colorado law, not US law.
1
“Accident” is not a helpful word in determining criminal culpability here. It means only that he did not intend to kill or injure anyone. That is why he was not charged with murder. Criminal culpability depends on whether he was negligent. The jury found that he was. You don’t get off just because you did not intend to kill someone.
1
An intentional killing is murder and he was not charged with murder. He was not convicted of and not sentenced for murder.
1
@soulbakin — I am aware that he turned down a plea deal.
