  3. Letcher County is small and the defendant is the Sheriff of the county. Everybody knows him. Its an obvious conflict. Of course he has to be held elsewhere for security reasons, at least.

  7. Having a public defender represent a defendant in a capital case through the preliminary hearing is nothing to worry about. I don't see why the judge made such an issue of it. It takes some time to retain a suitable attorney or to file for a public defender formally.
