  2. It is inappropriate to draw any conclusion from whether or not a defendant chooses to testify. She had no obligation to testify. Defendants are judged on the evidence presented at trial.

  4. It isn't a legal term, just a common metaphor. As used here, it means a sneak attack. In a trial, the lawyers on each side are supposed to provide everything to the other side in a timely manner.
