I suppose there are lots of legal reasons my take wouldn't fly, but this is how I see it: If the owner can't see the plans because of the builder, and therefore can't remodel without extra expense, then the builder not the buyer is the de facto owner of the home and ought to be responsible for the buyer getting his money back, i.e. pay him what he spent. Since my take is predicated on my sense of right and wrong rather than any knowledge of law, I guess there might be some legal eagles out there (armchair and otherwise) who'll pounce on it and they might be right; but I stand by my argument from the pov of justice versus the law.
