  1. The well-regulated militia had all along existed, and were all along UNDER the rule of law, with the colony governor as commander-in-chief.

  2. The "Declaration" was not a plan of gov't, so did not create the United States. And it was never law. After the "Declaration" the Continental Congress framed the "Articles of Confederation," which was a plan of gov't.
