  1. Until Heller there was a bright line between military and civil society. Scalia obliterated that by ignoring the legislative history on the Second Amendment which refuted his "individual right" holding.

  2. In Massachusetts law there is a statute apply to the "Ancient & Honorable Artillery Company," which was a 1600s militia. The law stipulates that it can march (which it only does on "Evacuation Day") with weapons but the weapons cannot be loaded. The Founders, regardless how reputationally "revolutionary," were no slouches when it came to controlling militaries and guns and other weapons. They routinely, from the 1600s on, engaged in every form of gun control including prohibition and confiscation.
