  1. That was my inclination: the Amendment is not self-actualizing; like most Constitutional provisions, it must be implemented by means of statute. And, as it is FEDERAL law, that would move the case to Federal Court. But the decision DID NOT overturn Colorado's fact-finding that Trump engaged in insurrection. That is consistent with the question the court wants the prosecution and defense to answer in the "immunity" case: the question did not use the words, "ALLEGED crimes"; it used the words, "ALLEGED official acts". They are focused on the complex question of where to draw the line between legitimate presidential immunity, and what falls outside that area. A president can order assassinations; but it would be prosecutable crime to assassinate domestic political opponents.
