  1. It's in the Constitution: CONGRESS establishes the courts, and determines the number of seats on the Supreme Court. The president has no say in the matter. The Supreme Court originally had 6 seats. And it has varied a number of times during the past 200-plus years. It's only controversial with those who substitute politics for rule of law.
