Actually not. Your law-illiteracy is not a substitute for the facts of normal legal process. Penalties, including gag orders, are incremental. In this instance the judge is sending the signal that he is moving beyond fines; the next step is jail. And as the reporter says: there is a cell in the courthouse; it isn't that long a walk.

The MEDIA need to STOP calling him "FORMER president" -- that is NOT an OFFICE or OFFICIAL POSITION -- and instead remind us that he's an ORDINARY CITIZEN.

Article95 Then we shouldn't be complaining that he has been getting due process. We should be raising the issue about others not getting equality before the law.

@andrewgocken517 EVERY defendant is PRESUMED innocent -- it is called DUE PROCESS. What you would want for yourself you should want for others -- else you be a mindless Trumper.

@SpinDoc420 He is CURRENTLY an ORDINARY CITIZEN; the honoric "former president" avoids stating that fact. It is the bridge between his CURRENT claim to BE president, and the FACT that he IS NOT THE PRESIDENT -- he is an ORDINARY CITIZEN. It does nothing to "spotlight" his crimes; it is more at excuse -- "Gee, may he has the RIGHT to commit crimes. Maybe he IS immune." "Former president" is not a special category; it is not an OFFICE or OFFICIAL POSITION. It DOES NOT impute any degree of "special" or "immunity". He is not charged as "former president"; he is charged as any ordinary individual would be. As Cohen was for essentially the same crimes.

It's amazing how you law-illiterates (1) know better than those who actually know better, and (2) refuse to learn from those who DO know.

@systemBuilder Is Trump being prosecuted in New York? Yes. Should he be prosecuted in red states? Yes. Will he be? The Georgia Senate -- Republican majority -- is going after Fani Willis.
1
Is Trump being criminally prosecuted? Yes. Whether he AND you agree or not, he is because on trial NOT above the law.

@jasonm1827 Yes. And I have an education in law. From your and others' like comments, it's is obvious that you and they are dong the same thing Trump is doing: IGNORING the ACTUAL law and legal process in order to do POLITICS. The court must both constrain Trump's POLITICAL attacks, while also being aware of the POLITICAL volatility he incites to threats and violence. Justice must be SEEN to be done -- against it CLEARLY being seen what the violations are, AGAINST the terms on the gag order. The court is engaging in PUBLIC EDUCATION, and you and those others are REFUSING to LEARN. And that is no different than TRUMP'S refusal to learn. This lawyer explains gag orders based on the several gag orders issued against Trump. LEARN from it: Trump Gagged Harder ft. Liz Dye https://www.youtube.com/watch?v=OQdD94evetA

Article95 Legal process is not a game. Neither is politics a game show. Defendants try to play games, prosecutors and judges prevent those as much as possible, within the rules. And the court is aware of external politics -- including that one of the purposes of prosecuting crime, and imposing sentences, is the publicity that causes deterrence. This is the fundamental you ignore: The defendant is PRESUMED INNOCENT -- that is DUE PROCESS. That is the Constitution Trump ATTACKS. The jury does not determine that the defendant is guilty; it determines whether the prosecution proved guilt.

@jasonm1827 I don't misunderstand those who insist on misunderstanding, and ignoring the free legal advice from those competent to give it. I adhere to the facts and law, and listen to those who know the law.

He is PRESUMED INNOCENT, UNLESS AND UNTIL THE JURY SAYS OTHERWISE. Legal penalties are INCREMENTAL: 2nd degree murder is not the same as 1st degree murder. Gag order violations are applied incrementally, up to the point that the defendant stops violating the order. In his latest ruling -- finding only one of three charges were violations -- is sending a signal: he is passing beyond fines, and that he knows Trump can cease the violations if he chooses to do so. And there is a cell in the courthouse: it is not a long walk to it. Doubtless his lawyers have told him that. But putting him there wouldn't be the big political media splash Trump wants.

@dennisthemenace8854 Um, no: the Founders were Liberals, which is why we have the First Amendment, which PROHIBITS political violence, so LIBERALS do NOT engage in political violence. Clue: Hitler ALSO hated Liberals.

@SpinDoc420 There should be NO reference to him that includes the word "president". He is an ordinary citizen and a criminal defendant. There are no special protections for him. All that rhetoric should be stripped away and deep sixed.

@Larry-yt5ys The judge knows what he is doing.

@jameszog Where is your EVIDENCE? Oh, right: you are too stupid to even know what evidence is.
