And it isn't "Democrats" because this is the fundamental Constitutional principle of which you and your all-politics-all-the-time avoidance of law-illiterates refuse to be aware: "Justice and the Rule of Law are to be ABOVE politics." -- John Adams. John Adams was the foremost constitutionalist among the Founders. He wrote the Massachusetts constitution, which established separation of powers into three co-EQAUAL branches, and subordinated all three branches to that constitution. And that constitution was the model for the US Constitution. "A system of Laws, and not of men." -- John Adams. The oath is to the Constitution, not to any person.

  2. Trump tried the same strategy in the DC case. On appeal by Trump it was rejected by a Trump-appointed judge.

  3. The special counsel prosecuting Hunter Biden was appointed and is funded identically to Jack Smith. And a Trump appointed appellate judge in the DC case, also being prosecuted by Jack Smith, rejected Trump's identical claim.
