  3. Biden doubtless recalls Nixon being called out for publicly declaring that Charles Manson was "guilty as sin," for which Nixon was justly criticizing as Manson had yet to have been tried. The only current issue to which Biden would be responding would be from Congress, and that is in the public domain. Republicans view truth as the enemy because it attacks their lies.

  11. It IS an important distinction, because Congress is a separate branch from the Executive branch, and the DOJ is in the Executive. All Biden could be responding to is the action of Congress.

  14.  @gak2008  He's been that since at latest the 2000 election theft. In interviews he conducted, Gore's legal team accurately represented Florida elections law, but G. DUI Bushit's legal team claimed the opposite of the Florida elections law. I know that because I was reading the same Florida elections law at the same time. Toobin didn't correct Bushit's team; instead, he left it to the viewer to "decide". But what Toobin did not do was show the viewer the text of the law.
