  2.  @alyssaj.2659  Well I think that since the age difference was only 2 1/2 years, the statutory rape charge seems misguided. Most states now have an age difference clause to account for the absurdity of, say, a 16 year old having sex with a 16 year old. To my mind, 2 1/2 years is at least in a grey area. In essence, this prosecution is tantamount to criminalizing ordinary teenage sex. Is that the route we really want to go? What if he were 18 and she 17? Or he 17 and she 16? Should that be statutory rape?
