Probably hard to get the McMichaels entirely off the hook 1) Their alleged citizen's arrest was by all acounts I've read, illegal in Georgie because they didn't witness a crime happening. 2) By displaying a deadly weapon, you are asking for trouble. This is the reason citizen's arrest is frowned on in this situation. 3) On this basis, I come up manslaughter.

@nustada But was it self-defense? Or was the gun already pointing at Arbery? If the latter, that would be assault with a deadly weapon.

Doesn't matter. He didn't deserve to die, He had apparent mental issues, it has been reported.

@daver1161 They conducted an illegal pursuit. Against Georgia law. Maybe this is the reason why. Confronting someone with a gun isn't wise. They created a situation with unnecessary risk, at best. But I have an open mind and can be convinced otherwise.

@daver1161 Well everywhere I look I read things like this: BRUNSWICK, Ga. (WSAV) – The McMichael’s told police they were attempting to make a citizen’s arrest. News 3 is looking at Georgia’s laws. Georgia’s Citizen’s Arrest Law allows people to arrest anyone that they’ve witnessed committing a crime in their presence or has immediate knowledge of the crime, but attorneys around the state say that wasn’t the case in Ahmaud Arbery’s death. Discuss

@daver1161 "trying to wrestle away a gun. You have the right to defend yourself if someone tries to disarm you." Well here's where it gets tricky. Suppose the rifle was pointed at Arbery the instant he comes around, which seems a good guess. So this would be assault with a deadly weapon. Can we be sure which way the gun was pointed?

And the McMichaels' biggest mistake was to pursue in an illegal citizen's arrest while displaying a deadly weapon. Not wise.

Problem: they did not witness him stealing anything. They thus pursued him illegally, according to what I've read about Georgia law. Who assaulted whom first we may never know.

While we don't have all the details, for me the mere fact these men rushed out the door to pursue a man they had not seen commit any crime, makes it illegal. And if you arm yourself and display weapons, and someone dies, that's manslaughter at the very least. I guess we will never know for sure if the gun was pointed at Arbery already. That would make it 2nd degree murder.

@eemage9476 I don't think he'll get life. Probably 10 years for manslaughter. We've swung from one extreme to the other. The truth may be in the middle somewhere.

@nustada "The truth is the left use racism to excuse their criminality." I would say it's more that the assumption is when white kills black it's automatically racism. In any one case you can't be sure.
