  5.  @damyr  Your point is mistaken. If you hire someone to kill a person and he does you are just as guilty. If your order is illegal in war something against the Geneva convention such as a massacre the one who orders it is just as guilty. The person controlling , ordering, arranging or causing for an illegal act is just as guilty as the one who carries it out. This principle is part of all domestic and international law and has been recognized for centuries.

  6.  @damyr  Of course but that does not excuse the person who ordered it. If there was no order the crime would not have happened.
