  1. it is unfair to not inform the jury. while it is true that telling the jury about the cap could influence them to move some of the punitive damages into being compensatory damages, I would not be surprised if the reverse is true as well: that juries might sometimes hold back on the compensatory damages, thinking that they are also assigning a significant amount of punitive damages, only for those punitive damages to then be cut by a cap they did not know existed.
