I am finding somewhat confusing how there is a difference between a "constitutional right" and a "clearly established constitutional right." wouldn't a right being explicitly stated in the constitution be a clear establishment of that right regardless of if anyone was stupid enough to violate it previously? because if not, then it sounds to me like the real problem with qualified immunity might simply be this distinction. surely, at the very least, the "would a reasonable person think it was acceptable" test that is used in things like negligence and recklessness, amongst other things, should be relevant here...
