Judge Dearie is doing something even more deep. He is setting the Trump team up to either provide their version of criteria for determining document status (classification in the non-national security sense) or to fold. “Speak now, or forever hold your peace.” He is saying, I’m going to set the criteria for judging the material and I’m going to base it on National Archives policy and practice. If you oppose this, show your specific objections or alternative criteria. Remember that the Trump’s team tactic to avoid specificity was to claim that doing so would prejudice Trump’s future criminal defense. This is the next step in nailing down Team Trump. If they insist on taking no position, they de facto accept Judge Dearie’s determination (probably based on National Archives policy and practice). If they still wish to challenge Dearie, they can appeal to Cannon or the 5th circuit. If they appeal to Cannon and she finds for Team Trump, the DOJ can appeal that decision to the 5th circuit. It’s very slow and methodical, but it gets the job done. I don’t think Dearie wants out of this case. I think he sees his job clearly, even if it becomes moot at the appellate level. His job is to clear up the muddied procedural waters created by Team Trump and Judge Cannon.
