@Jack Burton I don’t think it’s silly, it’s just not cut and dried. There are no requirements to be an actor; anyone can be one without training or qualifications. That said, it’s incumbent for the people in charge to make sure actors (or any worker) has the skills to do their job safely. If a scene calls for an actor on a horse, you want to be sure the actor knows how to ride a horse. Failing this is begging for accidents to occur. As I mentioned above, that goes for workers—those in charge of hiring the workers must insure that their workers have the skills and competency to do their jobs safely. If this is too great a burden, they should hire UNION workers. The various locals do have training programs to ensure their member workers understand safety and the safety rules that govern the set. It’s these low budget productions that want to save a penny by not hiring union that create these problems—and it’s no surprise that the same productions are sloppy and unsafe in other ways.

It’s called contributory negligence. The prop weapon house sold her what was essentially a defective product. Yes, the armorer is responsible for what she loads into a firearm. But the vendor is also responsible for providing the product as advertised. If the vendor failed in this duty, they share responsibility with the armorer. That said, I think it will be difficult for Gutierrez to prove the live bullet came from the vendor. It will not be difficult for the vendor to introduce doubt that Gutierrez was professionally sloppy, didn’t maintain access control to the weapons and blank ammo, and wasn’t at her post during the shooting.

It’s not known, it’s rumored. I’d stick with information released by the local authorities for known facts. Everything else is different people recounting what they remember. Some of those people have identified themselves, some are eye witnesses. Some of the rumors (such as the one you’re relating) seem to be hearsay.

It’s the armorer, not the company, that is suing the vendor. Did you watch the video?

What acclaimed director said this? I doubt any director would say this, because it’s not true. Perhaps you mean the assistant director, because that person is responsible for all moment to moment operations on the set, including set safety.
