  1. Texas can erect whatever fences or walls it wants on state lands or by agreement with owners of private lands. It can even use eminently domain to acquire land. Texas has never been prevented from doing so. But it cannot interfere with the flow of the Rio Grande or otherwise interfere with its course. This is by treaty, and states have no authority to violate, change, or enter into treaties. Texas would need to build its border fence set back a certain distance from the river. So your question should be why doesn’t Texas build a wall or fence? Not why isn’t it allowed?. It is already allowed. Texas cannot make up its own immigration laws. This was determined by the Supreme Court in Chy Lung v. Freeman, 92 U.S. 275 (1876). It has been reaffirmed and cited by the Supreme Court as recently as 2012. So, no, your other idea is a non-starter. The Governor of Texas is engaging in a publicity stunt that will eventually be shut down by the Supreme Court.
