  3. The court will follow the law, not prejudicially favor the police officer. Luckily, the law favors the police officer. State law makes the HOA regulation null and void, and this case will get tossed before it ever comes before a jury. The police officer might even be able to recover her legal costs. One thing I’d try if I was her defense lawyer (I’m not a lawyer): I’d ask the plaintiff (HOA) for their witness list and see who is willing to testify or sign an affidavit, BEFORE I asked the judge for a dismissal. I think that would be very eye opening for the community.
