The plaintiff is a dick, but he’s within his rights and this isn’t necessarily a trivial suit. Imagine your neighbor made a practice taking a shortcut through your backyard without seeking your permission. Maybe it’s to go to the store and maybe other people start using the short cut. Being an easy going guy, you let it happen. Perhaps the path is behind some bushes so it doesn’t affect your privacy. In some locales, if it becomes established as a customarily used public path, it could become a right-of-way. Then when you try and sell your house to someone, the potential buyer says, “look here, the records show that you’ve got a right away running through the backyard. I’ll offer you 80% of what you’re asking.” This is how trespassing can reduce the value of a property if left unchecked. It’s objectively on the minus column.
