  1.  @SylviaRustyFae  You realize that a disciplinary action against the defense attorney doesn’t have to be done on the spot? Indeed, it would be wiser to wait for the trial to conclude before entertaining such an action—then there would be no argument that it was prejudicial to the client.

  2. The exchange didn’t occur before the jury, so this won’t impact the jury. And really, the jury’s opinion of the penalty won’t be formed until both sides rest and the jury retires for deliberation.
